Cr(+)sshair
So...I had a fight with my kids mother around 11 AM a few days ago. 2 AM I decided to go to a bar to drink the fight out of me...come to find out she went to my moms house and kidnapped the kids out of custody jurisdictions. I was pretty tipsy, so I rushed there to find she was just pulling out. I chased her at top speeds (she had the kids in the car)...I ran two red lights and a stop sign to catch up on the small roads. I got there first by a shortcut, blocked her parents driveway in. I noticed my daughter wasn't even buckled in her car seat. Her father heard the top level yelling back and forth and told me I should leave now or else. I drove 2 miles and flagged down a passing officer. He told me I had to go back to my moms house and call 911 from there. I didn't wanna put that stress furhter on my mom so I went to the police station to file a report. The main reason why I was freaking out hardcore is because she's mentally unstable. She has a criminal history including suicide watches and assaulting police officers. I'm asking any NY HG members...if you could please show up at the new custody hearing when it comes...I need support through this and I'm a broken man not having my kids. Slazenger
wait what the hell? she kidnapped them and was allowed to keep them? uhm what. Makes no sense legally. Which is why I'm lost. You had legal custody, anything she can do certainly doesn't automatically reverse that. She can request another hearing, but you retain custody until the results of that. And given the fact that she kidnapped the children would place her under arrest and the kids with you, where they should be. Sounds a little awkward. If cops (and the legal system) are that bad in New York.... Best of luck.
Colonel Potter M.D.
when is the hearing? I might come if it is on a Monday or Tuesday Edited May 6, 2010 by Colonel Potter, M.D.
I Love Lamp
wait what the hell? she kidnapped them and was allowed to keep them? uhm what. New York custody laws are FUCKED UP. My Uncle's Ex-wife has admitted, under oath, in court, that she just wants their kids for child support. She's on anti-depressants and lost her job due to inappropriate conduct at work (i.e. banging her boss), and is currently under investigation for false insurance fraud claims (she tried to convince a life insurance company that my uncle had cashed in on a life insurance policy that didn't exist), and he STILL has an uphill battle for the kids. I don't know why, but courts in our county at least favor mothers over fathers. However, if you can prove that she is in imminent danger of herself, you should be able to at least get CPS to take your kids away from her. I'd hope that no matter how bad the custody laws are themselves, child protective services should still be smart enough to know that someone that is a danger to themselves and others shouldn't have kids with them. If not, that's one hell of a lawsuit.
